Asimismo, el TC determinó que no era posible calificar los hechos como delitos de lesa humanidad, dado que dicha figura no se encontraba vigente en la legislación peruana al momento en que ocurrieron los hechos. En ese sentido, el colegiado concluyó que se vulneró el principio de legalidad penal.

Pacheco indicó que el tribunal advirtió una afectación al debido proceso al haberse aplicado criterios normativos posteriores a la fecha de los hechos.
