La transferencia se realiza en el marco del artículo 15 de la Ley N.º 32513, Ley de Presupuesto del Sector Público 2026, que creó el Fondo para la continuidad de inversiones de los gobiernos locales.

Cabe señalar que este mecanismo financia proyectos comprometidos en 2025 con Recursos Ordinarios que no fueron devengados al cierre del año fiscal, siempre que cuenten con contrato vigente registrado en el SIAF-SP y el SEACE y que no hayan sido reincorporados en el presupuesto institucional 2026.
